    Importance of Will writing in Australia

    Considering the uncertainties of life, as no one can predict the time of his/her death, it is better to write a legal note called Will that facilitates the distribution of your assets to your near and dear ones as per your wishes. 

    What is a Will?

    A Will also referred to as the Last Testament in Australia, is basically a legal document that specifies in clear terms as to how your finances, assets, and property are to be handed over to a person or distributed among your legal heir, family members, friends or dependents, etc.

    The declarations made in the Will can prevent unnecessary confusion, arguments, and jealousy among claimants while saving a lot of precious time and money in the form of taxes and fees for legal proceedings.

    Your Will is considered as your definite intentions and wishes to be fulfilled which when properly made helps peaceful division or handing over of your financial assets, movable or immovable property, etc. to the persons as wished in this legal document.

    In situations where a person dies without a Will i.e. in the absence of a Will, distribution of property or assets will be decided by the Court. The court in such cases appoints a trustee executor for distributing the property to claimants as per the provisions. In such cases, usually genuine and legal heirs end up receiving much less property. 

    Apart from the above, they will have to pay the court fee and property taxes as per law that otherwise can be avoided by simply writing a Will.

    Accordingly, everyone in Australia must create a well-drafted Will so that it may serve its purpose without any arguments, enmity, or distortion in relationships among legal heirs, family members, or friends.

    What you may include in your Will?

    The very purpose of writing a Will is to ensure that your property is going to the person/s in right proportion as per your wishes in a peaceful manner after your death. So for writing an appropriate Will, it is essential to list down all your money, real estate assets, and other valuables like antiques, artwork, drawings, and paintings, etc. for distribution after your demise.

    In addition to the above assets, you may also nominate guardians if your property is to be inherited by young children like grandchildren along with the time of inheritance.

    Besides assets and property, in your Will, you may also make certain special wishes like a funeral, burial, and charities, etc.

    Now that it is established that a Will is of immense importance in Australia, the most important question that arises here is as to how to write a Will in Australia .

    Usually writing a Will is not considered a difficult task. People who do not know how to write a Will in Australia can download the Will templets through the internet and write their own Will as per their wishes. 

    Since writing a Will can be an emotional issue for many, it is advisable to consult a professionally qualified person who may impart specific advice, especially on complex matters.
